Hyresnämndsmål
Hyresnämndsmål. Enligt 3 § andra stycket lagen (1994:831) om rättegången i vissa hyresmål i Svea hovrätt gäller att, om en part i mål om ändring av hyresvillkor åberopar en omständighet eller ett bevis som inte har lagts fram tidigare, tillämpas 50 kap. 25 § tredje stycket rättegångsbalken. Med mål om ändring av hyresvillkor avses främst mål där hyresnämnden, då parterna tvistar om hyrans storlek, har att fastställa hyran för den fortsatta förhyrningen. Preklusionsbestämmelsen åberopades i ett mål om återbetalning av hyra enligt 12 kap. 55 f § andra stycket jordabalken. Hovrätten uttalade att tvisten i och för sig rör frågor om hyrans skälighet men att målet inte gäller ändring av hyresvillkoren eftersom det inte är fråga om fastställande av hyran för fortsatt förhyrning. Preklusionsbestämmelsen är alltså inte tillämplig i detta fall.
