Efter kallelse till konkursförhandling genom särskild delgivning med juridisk person, uteblev gäldenärsbolaget och försattes i konkurs. Hovrätten har ansett att förutsättningarna för att använda sig av delgivningssättet särskild delgivning med juridisk person inte har varit uppfyllda. Kravet på ett misslyckat delgivningsförsök i "samma delgivningsärende" enligt 29 § delgivningslagen (2010:1932) innebär att domstolen måste försöka delge varje delgivningsförsändelse en gång med vanlig delgivning eller förenklad delgivning innan domstolen kan använda sig av särskild delgivning med juridisk person.
