Hyresnämndsmål. Hyresgästen, en ensamstående mamma med fyra minderåriga barn, har allvarligt åsidosatt sina förpliktelser som hyresgäst genom att inte betala hyran. Vid skälighetsbedömningen har hovrätten beaktat bestämmelserna i Europakonventionen och Barnkonventionen om rätten till respekt för sitt hem och barnets bästa. Det har inte ansetts att det förhållandet att Barnkonventionen sedan den 1 januari 2020 gäller som svensk lag ger anledning att frångå den praxis som tidigare har utvecklats. Med stöd i denna praxis har hovrätten bedömt att hyresavtalets upphörande står i rimlig proportion till det åsidosättande som hyresgästen gjort sig skyldig till. Hovrätten har vidare ansett att det med hänsyn till risken för att hyresskulden ökar under uppskovstiden inte finns skäl att medge hyresgästen något uppskov med avflyttningen.
