En borgenär ansökte om gäldenärens försättande i konkurs utan åberopande av någon bestämmelse enligt vilken gäldenären skulle presumeras vara insolvent. Gäldenären försattes sedermera i konkurs efter egen ansökan i ett annat konkursärende och tingsrätten skrev av det av borgenären inledda konkursärendet samt avslog borgenärens yrkande om ersättning för rättegångskostnad. Borgenären ansågs ändå vara vinnande part och tillerkändes rätt till ersättning för sin rättegångskostnad.
