Ersättning för rättegångskostnad
Ersättning för rättegångskostnad. Den part som yrkar ersättning för utgiven mervärdesskatt har att, efter invändning från motparten, förklara varför skatten är en slutlig kostnad. Med hänsyn till de särskilda utredningssvårigheter som kan föreligga bör det normalt räcka att domstolen, på grundval av den utredning som kan finnas, bedömer det sannolikt att avdragsrätt saknas och att utgiften därför ska ersättas.
