Hyresnämndsmål. Ett hyresavtal har innehållit en förhandlingsklausul. Under rubriken "Särskilda bestämmelser" i hyresavtalet har det samtidigt angetts att hyran ska vara lägre än den förhandlade hyran med hänsyn till lägenhetens låga standard. Hovrätten har ansett det visat att parterna varit överens om detta. Enligt hovrätten har överenskommelsen utgjort ett särskilt hyresvillkor. Den förhandlingsöverenskommelse som träffats inom ramen för gällande förhandlingsordning om högre hyra för lägenheten har därmed inte ansetts bindande i förhållande till hyresgästen.
