Föreningen fullgjorde inte anmälningsskyldigheten beträffande samtliga områden som skulle avverkas

I samband med att ägare av fastighet upplät avverkningsrätt i fastigheten till en skogsägarförening avtalades det att föreningen skulle fullgöra den skyldighet att göra avverkningsanmälan till Skogsstyrelsen som enligt 14 § skogsvårdslagen (1979:429) åvilar skogsmarkens ägare. Föreningen fullgjorde inte anmälningsskyldigheten beträffande samtliga områden som skulle avverkas. Fastighetsägarna har inte ansetts ha förfarit oaktsamt när de förlitat sig på att föreningen gjort anmälan och inte själva sett till eller kontrollerat att anmälan gjorts.
