En man hotade en kvinna genom att bussa sina lösspringande hundar på henne. Kvinnan, som omedelbart ringde polisen, försökte därefter handgripligen hindra mannen från att gå tillbaka in i flerfamiljsfastigheten där han bodde. Kvinnan ansågs inte ha haft rätt att enligt reglerna om s.k. envarsgripande i 24 kap. 7 § andra stycket rättegångsbalken hålla kvar mannen i avvaktan på att polis skulle komma till platsen. Mannen friades på grund av nödvärn från ansvar för att han därvid knuffade omkull kvinnan. Däremot ansågs han ha gått utöver det tillåtna då han därpå tilldelade kvinnan ett knytnävsslag i ansiktet.
