Åklagaren har ansökt om resning till förmån för den tilltalade och yrkat ogillande av ett åtal för s.k. drograttfylleri. Med hänvisning till huvudregeln om fri bevisprövning har hovrätten - trots att endast ett urinprov åberopats som bevisning vid tingsrätten och det för s.k. drograttfylleri krävs att det under eller efter färden har funnits narkotika kvar i gärningsmannens blod - funnit att den omständigheten att något blodprov inte åberopats inte innebär att den rättstillämpning som legat till grund för tingsrättens dom kan anses strida mot lag.
