I samband med ett fastighetsköp utförde en besiktningsman för köparnas räkning en s.k. jordabalksbesiktning. Kort tid efter tillträdet upptäcktes att det rann vatten genom taket. Sedermera konstaterades att takläckaget orsakat röt- och mögelangrepp. - Hovrätten fann att besiktningen var att anse som felaktig och att köparna till följd därav var berättigade till avdrag på det pris de betalat för den utförda tjänsten. Däremot ogillades köparnas yrkande om skadestånd eftersom det inte var utrett att de lidit skada till följd av felet i tjänsten.
