En byggnadsnämnd hade i samband med beviljat bygglov meddelat föreskrift om att byggherren sedermera skulle komma in med markplaneringsritning som skulle godkännas av nämnden. Föreskriften sattes som villkor för att byggnadsarbeten skulle få påbörjas. Byggnadsnämndens förfarande har - i mål om överklagande av byggnadsnämndens beslut att inte godkänna ingiven markplaneringsritning - inte ansetts förenlig med plan- och bygglagen. - Regeringsrätten har ansett sig behörig att ex officio bevilja resning i bygglovsärendet, trots att beslutet om bygglov inte överprövats.
