Om skattetillägg har påförts innan åtal väckts för skattebrott kan inte förbudet mot dubbel lagföring och dubbla straff föranleda att en lagakraftvunnen dom i skattemålet undanröjs. Det gäller även om det skatterättsliga förfarandet avslutades sist och oberoende av om domen i brottmålet var friande och när den vann laga kraft (I och II).
