Patent- och marknadsöverdomstolen har, till skillnad från underinstansen, bedömt att skickandet av två varningsbrev inte var att betrakta som marknadsföring. Enligt domstolen innehöll varningsbreven saklig och nyanserad information om partens ståndpunkt i en tvist. Breven hade endast skickats till den påstådda intrångsgöraren och inte till någon kund, återförsäljare eller annan tredje part. Patent- och marknadsöverdomstolen fann att breven utgjorde led i en juridisk skriftväxling och att de påtalade åtgärderna inte var att anse som marknadsföring. Att varningsbreven innehöll felaktiga uppgifter om svenskt patentskydd påverkade inte bedömningen av om dessa utgör marknadsföring. Patent- och marknadsöverdomstolen har inte tillåtit att domen får överklagas.
