Ett bolag ansökte hos Patent- och registreringsverket (PRV) om registrering av kännetecknen Nefertiti i ord och viss figur. En förening påstod sig ha bättre rätt till kännetecknen enligt ansökningarna och förelades av PRV att väcka talan om bättre rätt vid Patent- och marknadsdomstolen vilket skedde. Föreningen gjorde i målet gällande att den genom inarbetning erhållit ensamrätt till kännetecknen samt att den även på grund av tidigare användning av kännetecknen har bättre rätt till dem. Patent- och marknadsöverdomstolen har nu, i likhet med underinstansen, bedömt att föreningen inte har visat inarbetning eller sådan tidigare användning av kännetecknen att föreningen ska anses ha bättre rätt än bolaget till kännetecknen i ord och viss figur. Domstolen har därför fastställt underinstansens domslut. Patent- och marknadsöverdomstolen har tillåtit att domen överklagas till Högsta domstolen.
