NJA 2019 s. 23

NJA 2019 s. 23, Supreme Court of Sweden (2019)

Judgment of Supreme Court of Sweden, 2019. Statutes applied: Sambolag. The headnote below is reproduced verbatim in Swedish, as published by the court.

Can you recover money paid for your partner's property after a break up?

Not according to NJA 2019 s. 23, unless you can prove it was a loan. A cohabitant had paid bills for the other partner's property, used jointly but not joint cohabitant property. The paying partner had the burden of proving a loan and failed. The Swedish Supreme Court also held that he had no claim based on unjust enrichment.
