Det är endast sådana åtgärder som genomförts utan bygglov med stöd av de bestämmelser som anges i 9 kap. 30 § tredje stycket PBL (s.k. attefallsåtgärder) som man ska bortse från vid bedömningen av planenlighet. Den komplementbyggnad som fanns på aktuell fastighet var inte uppförd som en sådan bygglovsbefriad åtgärd, utan med bygglov. Det saknades därför möjlighet att bortse från komplementbyggnadens byggnadsarea vid bedömningen av planenligheten. Även fråga om liten avvikelse.
