Att en ansökan om uppehållstillstånd på grund av anknytning har gjorts medför inte att ett lagakraftvunnet utvisningsbeslut inte får verkställas. Det var därför rätt av Migrationsverket att besluta om återreseförbud när den utvisade inte hade lämnat landet inom tidsfristen för frivillig avresa och särskilda skäl som talade mot att ett återreseförbud meddelades inte hade kommit fram.
