Ett beslut om placering i häkte m.m. av en förvarstagen utlänning förutsätter att ett beslut om avskiljande har fattats. Ett beslut om avskiljande förfaller då ett placeringsbeslut fattas. Migrationsverket har därför saknat stöd för att fatta ett nytt överklagbart placeringsbeslut avseende en förvarstagen utlänning som sedan tidigare placerats i häkte. Det har i denna situation inte heller varit möjligt att fatta ett nytt beslut om avskiljande, eftersom ett sådant beslut endast kan fattas om utlänningen vistas i Migrationsverkets förvarslokaler.
