För att uppehållstillstånd skall kunna beviljas för egna företagare måste för det första sökandens företagsplaner vara realistiska, vilket bland annat betyder att utlänningen måste ha en reell förmåga att driva den aktuella verksamheten. För att företagsplanerna ska anses som realistiska måste sökanden inte bara visa att han eller hon kan försörja sig på inkomsterna från näringsverksamheten. Sökanden måste även visa att han eller hon har ett verkligt och bestämmande inflytande över företagets verksamhet. För det andra måste sökandens försörjning vara tryggad och det krävs härvid att utlänningen visar att han eller hon redan vid ankomsten till Sverige har egna medel att leva av under i vart fall det första året.
