En arbetstagare hos en kommun avskedades från sin anställning. Arbetstagaren var medlem i ett förbund som väckte talan mot kommunen och yrkade bland annat ogiltigförklaring av avskedandet. Kommunen och förbundet är inte bundna av kollektivavtal i förhållande till varandra. Tvist har uppstått mellan förbundet och Sveriges Kommuner och Regioner (SKR) om SKR enligt 10 § andra stycket medbestämmandelagen med anledning av tvisten mellan förbundet och kommunen varit förhandlingsskyldigt gentemot förbundet. Arbetsdomstolen har kommit fram till att så inte varit fallet.
