How can personal data be transferred from the EU to the United States lawfully?

Chapter V of the GDPR allows a transfer on an adequacy decision, on appropriate safeguards or on a narrow derogation. For the United States the first route is the Data Privacy Framework, open only to certified recipients, and everyone else relies on standard contractual clauses with a transfer impact assessment.

This answer differs by jurisdiction — see EU, US, SE, NO and DE below.

The answer per jurisdiction

Sources

  • Article 45: transfer without further authorisation where the Commission has decided the level of protection is adequate.
  • Article 46: appropriate safeguards, including the standard contractual clauses, with enforceable rights for the individual.
  • Article 49: derogations for specific situations, read narrowly and not as a standing basis for routine transfers.

What it means for the company

Record which route each transfer uses, keep the certification check or the clauses with the assessment in the same file, and revisit it when the recipient or the sub-processor changes.

What it means for the individual

The privacy notice must state that data goes to a third country and on what basis, and you can ask for a copy of the safeguards relied on.

Next step

Check the recipient's certification and the module of the clauses in the same review, because the wrong module is the most common defect in a transfer file.
