When does a plant need a German emission control permit?
A permit is required to build and operate installations listed in the ordinance on installations requiring a permit, because they may cause particular harmful effects on the environment. Whether a formal procedure with public participation or a simplified procedure applies depends on the column in Annex 1 to that ordinance. Installations that do not require a permit remain bound by the operator duties in section 22 and are supervised by the competent Land authority; operating without a required permit is a criminal offence.
