Rule tree

1. If: inte(notified_scheme = true)

   The solution is not a European Digital Identity Wallet

   The wallet must be issued under a notified electronic identification scheme. Without that, the designation and the legal effects under Article 5a do not apply.

2. If: inte(assurance_high = true)

   Assurance level high is not reached

   The wallet shall be provided at assurance level high. Below that level it cannot be recognised as a wallet across borders.

3. If: inte(user_control = true)

   User control is missing

   The wallet shall ensure the user has full control over its use and over which attributes are disclosed to a relying party.

4. If: inte(data_separation = true)

   Data are not kept separate

   The provider shall not collect information about wallet use that is not necessary, and wallet data shall be kept logically separate from the provider's other data.

5. If: inte(free_for_natural_persons = true)

   A fee is charged to natural persons

   Issuance, use and revocation of the wallet shall be free of charge for natural persons.

6. If: inte(certified = true)

   Certification is missing

   The wallet shall be certified by a designated body before it may be provided as a European Digital Identity Wallet.

7. If: alla(notified_scheme = true, assurance_high = true, user_control = true, free_for_natural_persons = true, data_separation = true, certified = true)

   The wallet meets the checked requirements of the article

   The conditions checked are met. The wallet shall be recognised in all Member States by public and, in the cases set out in Article 5f, private relying parties.

8. If: qualified_signature = true

   Qualified signature shall be free for non professional use

   The wallet shall enable qualified electronic signatures, free of charge where natural persons use them for non professional purposes.

The article text as read

1. 1directly by a Member State;
2. 2under a mandate from a Member State;
3. 3independently of a Member State but recognised by that Member State.
4. 4securely request, obtain, select, combine, store, delete, share and present, under the sole control of the user, person identification data and, where applicable, in combination with electronic attestations of attributes, to authenticate to relying parties online and, where appropriate, in offline mode, in order to access public and private services, while ensuring that selective disclosure of data is possible;
5. 5generate pseudonyms and store them encrypted and locally within the European Digital Identity Wallet;
6. 6securely authenticate another person’s European Digital Identity Wallet, and receive and share person identification data and electronic attestations of attributes in a secured way between the two European Digital Identity Wallets;
7. 7access a log of all transactions carried out through the European Digital Identity Wallet via a common dashboard enabling the user to:
8. 8view an up-to-date list of relying parties with which the user has established a connection and, where applicable, all data exchanged;
9. 9easily request the erasure by a relying party of personal data pursuant to Article 17 of the Regulation (EU) 2016/679;
10. 10easily report a relying party to the competent national data protection authority, where an allegedly unlawful or suspicious request for data is received;
11. 11sign by means of qualified electronic signatures or seal by means of qualified electronic seals;
12. 12download, to the extent technically feasible, the user’s data, electronic attestation of attributes and configurations;
13. 13exercise the user’s rights to data portability.
