En offentlig försvarare, som upphört med sin verksamhet inom hovrättens domsaga efter det att målet avgjorts i tingsrätten, begärde i hovrätten förhandsbesked i frågan om att hans rätt till ersättning av allmänna medel skulle omfatta de merkostnader för tidsspillan och utlägg som kunde uppstå till följd av att han numera bedrev sin verksamhet långt ifrån den ort där domstolen var belägen. Hovrätten fann att omständigheterna var sådana att den offentliga försvararens begäran om förhandsbesked kunde prövas även om begäran framställts efter förordnandet som offentlig försvarare.
