Den tilltalade kontaktade målsäganden, som var närstående till honom, under falskt namn via internet och stämde träff med henne vid två tillfällen. Vid dessa möten förekom sexuella handlingar jämförliga med samlag mellan parterna utan att målsäganden kände till den tilltalades verkliga identitet. Förfarandet har bedömts utgöra ett otillbörligt utnyttjande av att målsäganden befann sig i en särskilt utsatt situation. Den tilltalade har därför dömts för våldtäkt enligt 6 kap. 1 § brottsbalken. Brotten har inte bedömts som grova. Även frågor om straffvärde och skadestånd.
