En advokat som vidtalats som ombud till en huvudförhandling i ett tvistemål vid tingsrätten anmälde att han var förhindrad att närvara vid förhandlingen eftersom han blivit vidtalad till samma tid av en annan tingsrätt till en flerdagarsförhandling i ett brottmål med häktade. Tingsrätten beslutade dock att inte ställa in huvudförhandlingen i tvistemålet. Sedan advokaten uteblivit från förhandlingen avvisade tingsrätten honom som ombud i målet. Hovrätten fann att advokaten hade varit oaktsam men att försumligheten inte utgjorde tillräcklig grund för att avvisa honom som ombud.
