Åklagaren har yrkat ansvar för våldtäkt av en utvecklingsstörd kvinna på den grunden att den tilltalade genom att genomföra ett samlag med henne otillbörligt utnyttjat hennes hjälplösa tillstånd på grund av störningen. Hovrätten har ogillat åtalet. Kvinnan kunde inte anses på grund av sin utvecklingsstörning permanent befinna sig i ett hjälplöst tillstånd.
