Enligt 1 kap. 20 § första stycket lagen (1992:1528) om offenlig upphandling skall på begäran av en anbudsgivare en av handelskammare utsedd person närvara vid anbudsöppnandet. Det förhål- landet att sekretess enligt 6 kap. 2 § sekretesslagen (1980:100) gäller för uppgifter som rör anbud har på grund av bestämmelsen i 1 kap. 5 § samma lag ansetts inte hindra att den upphandlande myndigheten till den av handelskammaren utsedda personen lämnar de uppgifter om anbudsgivare m.m. som behövs för en kontroll av öppningsförfarandet.
