Ett företag (A) hade med sjukvårdsstyrelse slutit ett vårdavtal, enligt vilket A skulle uppbära vårdersättning för den utförda vården. Enligt avtal mellan A och ett annat företag B, skulle B i av A upplåtna lokaler utföra en del av vården och uppbära patientavgifterna för den vården. Såväl A som B har ansetts direkt tillhandahålla sjukvård åt vårdtagarna och därför vara undantagna från skatteplikt enligt 8 § 1) lagen om mervärdeskatt och punkt 1 av anvisningarna till paragrafen.
