En person som köpt en bil på avbetalning med återtagande-och äganderättsförbehåll sålde bilen vidare innan skulden på bilen var betald. Den nye köparen tecknade vagnskadeförsäkring för bilen. Eftersom avbetalningsköparens skuld inte betalades sade avbetalningssäljaren upp krediten och krävde tillbaka bilen från den nye köparen, som förutsatts vid förvärvet inte ha varit i god tro. Bilen förstördes genom brand när den nye köparen fortfarande hade bilen i sin besittning. Han har inte ansetts som verklig ägare av bilen i försäkringsvillkorens mening.
