Föreläggande att ta bort dämme ----- Mark- och miljööverdomstolen har bedömt att länsstyrelsen har vidtagit tillräckliga åtgärder för att eftersöka den som utan tillstånd olovligen anlagt en fördämning. Eftersom det inte gått att fastslå vem som anlagt dämmet har länsstyrelsen haft rätt att rikta ett föreläggande att ta bort dämmet mot fastighetsägaren då fastighetsägaren har rådighet över vattenområdet och därmed också erforderliga faktiska och rättsliga möjligheter att ta bort fördämningen.
