Mark- och miljööverdomstolen ansåg att det fanns synnerliga skäl för ersättning för klagandens rättegångskostnader i mark- och miljödomstolen då lantmäterimyndigheten förfarit oaktsamt och klaganden behövt föra frågan till Mark- och miljööverdomstolen för att kunna ta tillvara sin rätt.
