Äldre rättighet som grund för omprövning av vattenverksamhet för moderna miljövillkor ----- Sökanden har som grund för sin behörighet åberopat ett tillstånd eller en sådan särskild rättighet att förfoga över vattnet som avses i 5 a § lagen (1998:811) om införande av miljöbalken. Mark- och miljööverdomstolen har konstaterat att den frågan har betydelse såväl för behörigheten att ansöka om omprövning som för prövningen i sak (dubbelrelevanta rättsfakta). Om det inte är uppenbart att sökandens påstående att det finns ett tillstånd eller en rättighet inte kan vinna bifall (påståendedoktrinen) ska ansökan inte avvisas på den grunden utan domstolen har att ta ställning till frågan som en del av prövningen i sak.
