Byggsanktionsavgift för rivning av q-märkt fabriksskorsten ----- En bostadsrättsförening har utan rivningslov rivit en skorsten som i detaljplanen pekats ut som särskilt kulturhistoriskt värdefull och på grund av det påförts en byggsanktionsavgift. Mot bakgrund av att det funnits en överhängande risk för att skorstenen skulle kollapsa har Mark- och miljööverdomstolen bedömt att det varit nödvändigt att riva skorstenen för att undanröja risk för människors liv eller hälsa och för att avvärja eller begränsa omfattande skada på annan egendom (se 11 kap. 56 § 2 plan- och bygglagen). Domstolen har därför upphävt beslutet om byggsanktionsavgift.
