Mark- och miljööverdomstolen fann att mark- och miljödomstolen borde ha gett sökanden möjlighet att komplettera utredningen och mark- och miljödomstolen hade därmed brustit i sin utredningsskyldighet. Den kompletterande utredning som sökanden gav in till Mark- och miljööverdomstolen borde i första hand prövas av mark- och miljödomstolen varför målet visades åter dit för en ny prövning.
