Tillsyn ----- Mark- och miljööverdomstolen har funnit att omställning av mark från skogsbruk till åkermark omfattas av anmälningsplikt enligt miljöprövningsförordningen. Det har därför inte funnits förutsättningar för länsstyrelsen att med utgångspunkt från bestämmelsen i 12 kap. 6 § miljöbalken utfärda förelägganden i egenskap av tillsynsmyndighet. Inte heller har det funnits förutsättningar för Skogsstyrelsen att agera som tillsynsmyndighet eftersom omställningsåtgärderna inte ansetts utgöra skogsbruksåtgärder. Behörig tillsynsmyndighet har i stället varit den kommunala nämnden. Mot denna bakgrund har underinstansernas avgöranden upphävts.
