Mark- och miljööverdomstolen fann att grannen saknade talerätt då dels laga kraftägd detaljplan medgav bygge av huset med viss utsiktsstörning, dels beträffande kvarvarande bygglovsfrågor grannens hus var beläget 230 m från nybygget och störningen ansågs alltför begränsad för att grunda en talerätt. Att grannen fått talerätt tidigare i processen när inhibitionsfråga bedömdes påverkar inte bedömningen om talerätt föreligger när målet avgörs slutligt.
