Tillsynsbeslut om förbud mot fortsatt vattenverksamhet ----- Mark- och miljööverdomstolen fann att länsstyrelsens beslut att förbjuda utövare av vattenverksamhet avseende vattenkraftproduktion, som saknade tillstånd men som hade visat att de hade rätt enligt privilegiebrev att förfoga över vattnet vid anläggningen, att bedriva verksamheten var alltför ingripande. Länsstyrelsen bör dock, för att kunna fullgöra sin skyldighet att utöva tillsyn, kunna förelägga en verksamhetsutövare att ansöka om tillstånd till bedrivande av vattenverksamheten för fastställande av villkor för densamma. Målet återförvisades därför till länsstyrelsen för fortsatt handläggning.
