Avvisad ansökan ----- En kommun ansökte om tillstånd enligt 11 kap. miljöbalken att bl.a. leda bort inläckande grundvatten i en planerad kraftledningstunnel och tillhörande tillfartstunnel. Miljödomstolen anförde att bortledning av grundvatten kommer att ske i varje punkt i tunnlarna och avvisade ansökan med hänvisning till att kommunen inte visat att den hade rådighet beträffande samtliga de fastigheter som tunnlarna skulle passera. Miljööverdomstolen konstaterade att kommunen ägde de fastigheter där pumpanläggning för bortledande av grundvatten och pumpledning skulle förläggas och att kommunen därmed hade den rådighet som krävdes.
