Miljödomstolen biföll bolagets yrkande om ersättning av staten

Ersättning enligt 26 § naturvårdslagen ----- Länsstyrelsen hade genom ett interimistiskt förordnande enligt 11 § naturvårdslagen förbjudit ett bolag att anlägga ett tillståndsgivet vattenkraftverk eftersom området skulle avsättas till naturreservat. Miljödomstolen biföll bolagets yrkande om ersättning av staten. Miljööverdomstolen fann att bolaget inte hade rätt till ersättning för försvårande av pågående markanvändning då bolaget inte hade ansökt om dispens från förbudet. Ett avslag på sådan ansökan var enligt bestämmelsens ordalydelse en förutsättning för ersättning. Staten genom Kammarkollegiet var således inte ersättningsskyldig.
