Ett förvarsbeslut upphävs när ett beslut om avvisning eller utvisning verkställs. Om utlänningen återvänder till Sverige och på nytt tas i förvar, kan det beslutet inte anses vara en ny prövning av det tidigare förvarsbeslutet utan är ett nytt beslut om att ta utlänningen i förvar. Det är detta senare beslut som därefter ska prövas på nytt inom den tidsfrist och i sådan ordning som gäller för den prövningen.
