Sjuårsperioden ska beräknas från tidpunkten när ansökan kom in till Migrationsverket

Vad en ansökan enligt utlänningslagen gäller och vilka omständigheter som är föremål för prövning är avgörande för om det är omständigheterna vid ansökningstillfället eller vid tidpunkten för prövningen som ska läggas till grund för bedömningen. För att beviljas ett permanent uppehållstillstånd enligt 5 kap. 5 § utlänningslagen måste utlänningen ha haft uppehållstillstånd för studier som avser utbildning på forskarnivå i sammanlagt fyra år under de senaste sju åren. Sjuårsperioden ska beräknas från tidpunkten när ansökan kom in till Migrationsverket.
