Ett beslut att utvisa en utlänning verkställs när han eller hon lämnar Sverige. Om utlänningen varit förvarstagen i samband med verkställighetsförfarandet upphävs beslutet om förvar de facto när utvisningsbeslutet verkställs. Om utlänningen återvänder till Sverige och det fattas ett nytt beslut om förvar är det detta senare beslut som är bärare av tvångsåtgärden.
