En person har av allmän domstol dömts för bl.a. mord till livstids fängelse och utvisning. Vid en efterföljande prövning av om uppehållstillstånd ska beviljas med stöd av 12 kap. 16 b § utlänningslagen ska frågan om det finns skyddsskäl enligt 4 kap. 1-2 a §§ samma lag prövas först. Det brott som utlänningen gjort sig skyldig till har bedömts utesluta honom från att anses som alternativt skyddsbehövande. Livstidsstraffet medför att det inte är fråga om en endast tillfälligt avbruten verkställighet och det är heller inte meningsfullt att pröva frågan om verkställighetshinder.
