En asylsökande har i sitt hemland dömts för allvarlig brottslighet till ett långvarigt fängelsestraff. Det finns grundad anledning att anta att han, i samband med att påföljden verkställs, riskerar att utsättas för omänsklig eller förnedrande behandling på grund av de förhållanden som råder i fängelserna där. Han har därför ett sådant behov av internationellt skydd som kännetecknar en person som är alternativt skyddsbehövande. Mot bakgrund av de grova brott han dömts för i hemlandet är han emellertid utesluten från att anses som alternativt skyddsbehövande. Den behandling mannen i nuläget riskerar vid ett återvändande dit utgör dock ett absolut verkställighetshinder, varför han beviljas uppehållstillstånd i Sverige.
