I ett verkställighetsärende kan en åberopad ny omständighet som handlar om ett lands vilja och möjlighet att ta emot en utlänning vara såväl ett praktiskt som ett politiskt verkställighetshinder. Det krävs en bedömning i varje enskilt fall för att avgöra om verkställighetshindret enbart är av praktisk natur eller om det även hänför sig till utlänningens behov av skydd. Medan migrationsdomstolarna har en begränsad roll i den prövning som kan förekomma på verkställighetsstadiet åligger det Migrationsverket att självmant och kontinuerligt beakta de nya omständigheter som kommer fram i ett verkställighetsärende.
