I mål om medborgarskap har en man, som först hade uppehållstillstånd enligt EES-avtalet men som efter det att uppehållstillståndet löpt ut fortsatt att vistas här utan att ansöka om nytt eller förlängt uppehållstillstånd, ansetts ha vistats här lagligen och därmed ansetts uppfylla kraven för permanent uppehållsrätt enligt 3 a kap. 6 § utlänningslagen (I och II). Det har även ansetts att hemvisttiden i 11 § 4 medborgarskapslagen för EES-medborgare ska beräknas bakåt i tiden räknat från den dag då ansökan om medborgarskap lämnades in till behörig myndighet (I).
