För att uppehållstillstånd ska komma ifråga sedan ett avlägsnandebeslut preskriberats krävs att verkställighet inte har kunnat ske trots att utlänningen fullgjort sin skyldighet att medverka till verkställigheten. Skyldigheten att medverka till verkställigheten innefattar bl.a. ett krav på att den ut- eller avvisade i så stor utsträckning det är möjligt aktivt deltar i arbetet med att fastställa sin identitet. En ut- eller avvisad person som visserligen inte har hållit sig gömd eller på annat sätt undvikit kontakt i samarbetet med de verkställande myndigheterna, men som i övrigt förhållit sig passiv har inte ansetts uppfylla kravet på medverkan.
