Rättssäkerhetsskäl talar för att förvarsfrågor, där det finns mer än en handläggande myndighet och den ena har ansvar för verkställigheten, skall handläggas av sistnämnda myndighet. - Ett beslut om uppehållstillstånd saknar laga verkan om allmän domstol beslutat om utvisning på grund av brott. En utlänning som dömts till utvisning på grund av brott har ändå rätt att ansöka om uppehållstillstånd som flykting eller skyddsbehövande i övrigt. Vid avslag, i en administrativ process, på en ansökan om uppehållstillstånd, skall i regel beslut om utvisning meddelas även om allmän domstol redan beslutat om utvisning på grund av brott. - Fråga också om uppehållstillstånd på grund av skyddsskäl för den som begått ett allvarligt brott samt om migrationsdomstolens sammansättning.
