Om en förvaltningsmyndighet eller kommun finner att en verksamhet eller åtgärd endast kan tillåtas enligt 2 kap. 9 § första stycket eller 10 § eller enligt 7 kap. 29 §, skall förvaltningsmyndigheten eller kommunen med eget yttrande överlämna frågan till regeringens avgörande. Detsamma gäller om regeringen skall pröva tillåtligheten enligt 17 kap. 1 § eller om regeringen har förbehållit sig prövningen av tillåtligheten enligt 17 kap. 3 §.
Att det finns en skyldighet att underrätta regeringen om verksamhet enligt 17 kap. 3 § framgår av 17 kap. 5 §. Lag (2001:437).
